Medicaid Assisted Living And Parents House

Card image cap

Location: Illinois

Parent is likely entering assisted living / nursing care soon, no money other than social security for income, no savings. they own a home with a substantial mortgage. Parent has never been good with money, the home is financed for more than it is likely worth due to its dilapidated state and animal damage.

I, only child, out of state, do not want the house nor the furniture. Most home contents would not be considered clean or desirable to be sold. I will retrieve photos and some mementos, but otherwise no interest in the estate as a whole.

What are my legal obligations as next of kin here? I will not be paying for any part of the house or the assisted living.

Will the bank simply foreclose on the home and sell the contents? With other relatives who owned their homes, the sale was forced by the facility ( Medicare?) and taxes had to be paid until a sale was completed. That will not happen here as there is no money other than social security which will be taken for the facility.
