Motorcycle Dealer Screwed Up
Location: MA
Hey folks, coming here to try and look for some advice on an issue that is frankly still evolving.
I purchased a brand new 2026 YAMAHA R3 Motorcycle as my first Bike last week. Picked it up from dealer Wednesday on a Uhaul trailer and brought it home. Gave it a first ride yesterday. Long story short it's confirmed the thing doesn't have Oil in it. I got about a quarter of a mile down the road when the light flipped on and I stopped to check since it's the first time it's been ridden. There's a little window to check the level. (vs. a dipstick in a car.) As far as motorcycles go you can't check the oil unless you have it stood straight up instead of on its kickstand so it's not something you can check super quick or easily without doing some balancing act with the Bike. I was able to stick my phone flashlight into the Crankcase from the oil hole? Drain? And I can't even see any residue on the parts inside.
As far as vehicles go this is a huge issue. An engine running for even a short period of time with low to no oil can do enormous damage to the engine. I called up the dealer and they seem apologetic and are offering to take the Bike in by delivery to their shop and take a look, fix their issues. They said their sister location did the pre-ride inspection and they aren't sure what happened in between that and getting it shipped to them and in my hands.
With that being said I'm trying to plan for the possibility this bike craps out on me in 100 miles. Even if they give it a clean bill of health now, put oil in it, and say the engine isn't damaged. In 3 months when a brand new bike goes bad what recourse do I even have? I have no warranties on this bike and basic injury insurance as required by MA law. The only warranty I have is the manufacturer one but that covers defects and does not seem to cover dealer neglect. There is 1 mile on the odometer. From dealer pre-ride plus maybe a quarter of a mile I gave it myself.
Do you folks think there's I'll have any legal standing if I try and go a legal route and get opinions? I paid for Dealer Setup and Assembly on the deal. If I didn't get that. I mean what did I pay for?
I'm just worried $6k is about to go out the window over someone else's mistake that I can't get covered. And In 3 months I have doubts a dealer will give a crap whether they were the root cause or not.
