Moving Company Overcharging Us, Now Deferring Payment To Foreman

Our moving company sent us a second bill of lading after the goods had already been loaded and left the property, upcharging us by $1700 for cubic footage allegedly used that was not quoted.

In not sending us the second bill prior to the goods being loaded, the bill is null and void, per FMCSA rights and responsibilities during a move. I called the moving company today to tell them this.

They agreed with me (which I'm shocked by) and said they'd have someone reach out to me soon from billing to discuss further. After an hour I get a call, not from billing, but from the foreman who handled my move, saying that they're making him pay the $1700 upcharge instead of us.

This is the company's fault and theirs alone. The dude didn't write the contract or bill us, he was just there to move our things (which haven't been dropped off yet after 5 weeks of waiting). I know it isn't legal to make us pay this, but is it legal to make the foreman pay the extra costs when this isn't his fault in the slightest? I'm not sure if this is a manipulation tactic on behalf of the moving company or what, but listening to this man cry and plead with us to not move forward with this claim or else he'll have to pay the difference or risk his job is so incredibly fucked. I don’t know what to do. We are two people in low-paying job fields that could barely afford the $2500 move in the first place, let alone an additional $1700. The guy doesn't deserve to be saddled with these charges, and I don’t know how to respond that helps both him and us. Any help would be greatly appreciated.
