My Dad (kinda) Stole My Car.
Location: North East KY
So I just got out of jail in June, my arrest included a DUI. My car was towed at the time of my arrest. While trying to get legal help, I asked my dad to contact a specific lawyer for me. One who was terrible and left me hanging in jail for months. The lawyer he hired was supposed to send an official letter to the tow company to release it to my father. They never did. After an extended period the lawyer came and had me sign the power of attorney over to my father in order for him to be able to have the care released to him. Because they took their time getting the car back, it cost around $2,400 to have the car released. I was still in jail for several months (Due to the work or lack there of from the cheapest attorney he could find) While I was locked up he switched my car over to his name, cancelled my insurance, and put it all over to his name. All without asking or consulting me. After letting me waste in jail for nearly 8 months on bogus charges, he finally contacted the lawyer I requested in the beginning. The good lawyer got me out almost immediately. Now that I'm out, nearly done with DUI classes, and to where I can get a decent job again, he's talking about selling my car. I didn't even know he signed it over to himself without my permission until a week or so ago. It was literally the only property/item of value I had to my name. He said I can have it back when I pay him $2,500, and "not to sweat it" in reference to him selling my car for 10-12k because he doesn't think anyone will offer him that for it. However, I don't want him to sell my car. I never wanted him to own it. He did it behind my back with the power of attorney that he was only supposed to use for getting it out of the tow lot. His logic for doing that was because "his insurance was cheaper" But now I'm in a situation where I'm stuck living at his house, he owns my car, expects me to pay him in order to have my property back that he took without permission, and won't be able to pay him back without having a car. Am I screwed because he had the power of attorney? What should I do if he tries to sell it? I had every intention of paying him back for the lot fees, but I really don't appreciate the way he's gone about it. Especially commandeering the car without my knowledge while I was in a vulnerable position. I've kinda been like an indentured servant around the house while in debt and unable to leave. Digging ditches, doing a load of house work, a ton of outdoor work. I'm stuck. I haven't brought it up, but I was thinking maybe I should discuss an hourly wage toward my debt for all the work I've been doing around here. However, I can see it as just the cost of me being allowed to live here. Any helpful advice would be greatly appreciated. Thank you.
