My Dad Passed Away A Week Ago. His Brand New Truck Is Missing. He Paid For It In Cash. Some How The Landlord Has It.

Location: Massachusetts.

My dad passed away one week ago. The detective called me and told me and I was the first to be notified of my dads passing.

The medical examiner has said that my dad passed away and laid in his bed for 5-7 days dead. My dad was severely mentally ill, always on and off his meds, a veteran, and in a wheelchair. The home owner knew all this.

The landlord supposedly took my dads 2025 Ram 1500 truck on July 1st. My dad bought the truck new with cash in 2025 from the dealership. Two months later my dead could never walk again.

After my dad passed one of my sister's and I went into the rental to retrieve a few of his belongings and things are missing. We found a bill of sale that the landlord wrote and put after my dads name "of sound mind" and then wrote my dads name at the end of the bill of sale and his own name as well. The signature isnt my dads signature. The title and expires registration is still in my dads name. The title is at the New Hampshire RMV. My dad never recieved the title because it was sent to the wrong address. Again, he was mentally ill. He was also deemed incompetent for all of February 2026 at the hospital.

There is also thousands of dollars missing out of his accounts (we are beneficiaries) that was sent to the landlord. We hand to go through my dads bed were he died (not a pretty scene) to find his phone. His phone has evidence on it what the landlord did to my dead for his truck and the money. My dad was paid up until October 1st 2026 on rent.

Every time the landlords say we are allowed to start getting my dads belongings out of there house. We will be there for a few minutes and then they tell us to leave because we are not the exector yet. Its a mess. They asked us to pay off the lease and move all his stuff out 1 hour after he was deemed dead.

So what can I do? We have hired an attorney but he said this will take a long while. Im just dumbfounded that someone can get away with this.

I need all advice.

EDIT: Landlord said he bought $46,000 truck for $9,900. There is no money in my dads accounts from him. No check at my dads house. No cash either.
