My Father Is Trying To Control Me From Beyond The Grave! Help!

My father passed away a few weeks ago and my sister, Mary, is the executor of his will. The will requires that a Testamentary Special Needs Trust be established for my 1/3 of the inheritance. It also names Mary as trustee. Apparently, however, my sister is still required to petition the court to become the trustee (see her notes)(?)

I have been ‘no contact’ with my sister for the past ~3 years, specifically because she refuses to respect my boundaries. For instance, the reason I went ‘no contact’ with her was because she shared my private information on Facebook without my permission, after I explicitly asked her not to.

About 3 years ago, I was diagnosed with terminal cancer, something that was not known when the will was created or when it was later amended. The will stipulates that she (or her children) are to receive any remaining funds in my trust.

Because *she* has to petition the court to be granted the role of trustee, I’m considering petitioning the court to remove her as trustee on the grounds that preventing me full access to my inheritance, when I’ve been diagnosed with a terminal disease (again, not known when the will was last amended) seems cruel and unusual. Since historically, she has been irresponsible with my private information, might that possibly help my case to dismiss or change the trustee?
