My Hoa Is Fining Me For Solar Panels That Were Approved Years Ago
Location: Arizona. I just need to know if I have any recourse here. This feels completely unfair and like a bait and switch.
Back in 2022 I bought my house. Part of the appeal was that it already had solar panels installed on the roof. They were put in by the previous owner around 2020. There are documents in my closing paperwork showing that the HOA approved the solar panel installation back then. My realtor even confirmed it was all good.
Fast forward to last month. I got a letter from the HOA saying I'm in violation of a new rule about roof aesthetics and they're fining me $50 a day until the panels are removed. They claim the panels don't blend in with the roof line and are a visual nuisance. When I called them, they said the previous approval was under an old set of rules and the new rules supersede it. They even said they updated their bylaws in April 2026 and sent out notices to everyone.
I never got any notice about new bylaws. I checked my email and mail and found nothing. My neighbors, some of whom also have solar, got the same letter. Is there anything we can do to fight this? It seems crazy to fine someone for something that was approved years ago especially when I bought the house with them already there.
