My Husband Sold A Guy A Car. He Never Came Back To Get It. Legally, What Are My Husband’s Options? (california)*
Location: California
A couple of months ago, my husband sold a car to someone. The man came to our house, paid my husband $580, and left with the car keys and title.
Half an hour later, the man returned. He requested that we give back $200 of the money he’d paid, saying that he had a family situation. He gave back the car keys and title and said he’d return for the car “in a couple of days”.
Since then, two months have passed. We’ve heard nothing from him.
We have attempted to contact him by calling a number listed at the address he wrote on the “Notice of Transfer and Release of Liability”. (This is a form which in California, gets returned to the DMV by the previous owner, my husband.) Edit: We are about to send a letter to that address as well.
We have tried to find him by other means, including asking others who may have used his services if they have heard from him.
We would like to get the car out of our driveway, either by selling it to someone else or to a junkyard. We are happy to give him the remainder of the money back if he ever returns.
What are our options?
*Yes, I blatantly “borrowed” the title from a post someone made a month ago, but the circumstances are a little different.
