My Landlord Entered My Apartment Without Notice While I Was At Work And I Found Out Because My Neighbor Mentioned It.
Location: Oregon. I've been renting my current apartment for about 14 months, no issues with the landlord until recently. Last Tuesday I came home from work and my neighbor in the unit across the hall mentioned casually that she saw my landlord and a man she didn't recognize going into my apartment around 2pm. I was not notified in advance, I did not give permission, and I recieved no follow up message or explanation afterward. Nothing was visibly moved or missing as far as I can tell, but that's not really the point.
I checked my lease and it says the landlord will provide reasonable notice before entry except in the case of emergency. There was no emergency that I know of. The boiler and plumbing in the building have been fine, no maintenance requests from me were pending, and nobody has contacted me since to explain what the visit was about. I texted my landlord two days after finding out and asked directly why he entered and who the other person was. He replied saying he was "just checking on things" and that he has the right to access the property. He did not address the lack of notice or explain who the other person was.
I looked it up and my understanding is that Oregon requires at least 24 hours written notice for non emergency entry. I'm fairly confident this was a violation but i'm not sure what my actual options are here. Can I file a complaint somewhere, does this affect my ability to break the lease if i wanted to, and is one incident enough to do anything or do i need to document a pattern first?
