My Mom Had 2 Children Prior To Marrying My Dad. When She Died, He Didn't Include Them As Heirs In Probate. What Can I Do?
Location: Florida.
I lost my mom in 2023 suddenly, she had no will or legal matters in place regarding her death and affairs. She had 4 children and was married to my dad, two of the children are not biologically related to my dad. My dad did not include my other two siblings who are not related to him as potential heirs in probate matters; it was like they never existed. My dad had verbally agreed to sell my mom's house to me, I did put money into the home in various ways after this agreement with witnesses and receipts; ultimately, he sold it to someone else for $50,000 after probate settled. I understand that the reason my dad didn't list my other two siblings is because in the state of Florida, with other children not biologically related to the surviving spouse, all heirs are essentially entitled to 25% of the "estate" including my dad. This isn't surprising given his abusive nature all of my life, but he has since moved on, remarried, and doesn't speak to me. I feel like I am owed something, not by my mom (may she rest in paradise), but by him and I am hoping I have cause for a case of some sort.
What is the likelihood of an attorney being willing to take on the case, even if even only regarding the false claim on probate that disregards my two siblings? TIA.
