My Truck Was Stolen From A Mechanics Yard.

Okay im going to try and make this as short at possible.

On February 14th my truck was stolen from in front of my house. I filed a claim with my insurance but waited to receive the payout because I wanted my truck back and was told by police that they usually find them within a couple of weeks.

A few weeks go by and my truck gets found. Its dirty and the bed is full of trash but its still mechanically sound. The only damage is to the ignition and cosmetic pieces surounding the steering column.

I notify insurance and take the truck to a shop, (that ive gotten work done at before) after I clean it out and take it through a car wash. I explain to them the situation and give them a steering wheel club that I purchased that day. They say theyll start sourcing parts and to let them know when insurance has their quote numbers.

About 10 days go by and I get a call from them saying that my truck has been stolen again from their locked yard. Nothing else was stolen, just my truck. I notify my insurance and they tell me theyll offer me the original payout-which isnt a very fair one- or I can go after the shops insurance if I think I have a case.

So this is where things go even more south.

Ive been asking these people for their business insurance for 40 days now and the last time I went in I was screamed at and told to "get the fuck out". The guy just kept repeating "i didnt steal your fucking truck you cant blame me".

Im not sure if their uninsured or just being difficult but neither would surprise at this point.

The truck is only worth about 7k in my opinion but I really dont want to have to go through my insurance to receive that payout.

In my mind this should be a cut and dry situation where the person who was in position of it should be responsible if something happened. Especially since I never signed a waiver or anything. Is that correct or is there some weird set of laws that protects businesses in these types of scenarios?

Also if they dont have insurance will I just be taking the owner directly to small claims court for the damages?

Lastly, and I understand this is the hardest one to answer. My insurance is getting pretty impatient with this whole thing and they want me to either settle with them or toss the claim.

Should I feel confident enough in my ability to win this that I toss the claim with my insurance? I have a lawyer provided to me through work so ill have legal help, it might just take a while.
