Nc, Usa - Doctrine Of Necessaries
My wife passed earlier this year. In NC, there is a law (doctrine of necessaries) that makes her medical debt my responsibility. I got a letter from a hospital system the other day stating that they intend to pursue recovery through me and to expect any outstanding bills to arrive in the mail. Just today I got notification on my My Chart that I have an outstanding balance. It is my wife's balance that they have made me guarantor on.
I have not seen any legal documentation or anything. I know that I will be held to pay this balance, but I don't want to let the hospital just do whatever it is they want without following legal processes. Is anyone able to explain how the transfer of debt is to work? Are they able to just identify me and change my wife's account to say I am guarantor? Do they need to seek some kind of transfer through the courts? There wasn't even any kind of verification that she was my wife.
I'll pay when I have to pay, but I want them to dot their I's and cross their T's and do things right.
