Need To Break Lease!!
Location: Collingswood, NJ
I just moved into an apartment complex about two weeks ago. So far:
- Loud banging beneath my unit every weekday because our unit is directly above the entire maintenance area for the whole building, occurs 6a-2p every weekday at random intervals, have called many times about this for the past week and still leasing office / maintenance does not have any answers for me / won't stop it. Once when I was woken I went downstairs to see what was happening and I heard maintenance through a door, I tried knocking and speaking to them and they practically mocked me and were rude and even threatening so I left, they wouldn't even open the door to speak to my face. This was not mentioned in the lease.
- Roach and mouse infestation throughout entire building; we have not seen any mice yet, but other neighbors report it and you can HEAR THEM in the vents scratching and skittering. Both adult roach and baby roach have been found and documented in our bathroom meaning there is a colony nearby. Roaches are throughout ALL four buildings in complex and I plan on contacting other neighbors for their stories for potential class-action. Will be contacting health dpt. and am notifying leasing ASAP.
- False late rent charge that we have written email proof from head of leasing that they fucked up on our VERY first payment. Was only corrected AFTER I raised the issue through email and in-person. (Money order for security deposit and first few days / first month of rent and utilities)
How can I break my lease as soon as possible? I just moved from Alabama and all of the rest of my stuff is in a PODS moving unit coming in tomorrow. I am NOT going to move the rest of my stuff in while this place is infested which means extra costs for me as well as all of the costs with potentially breaking my lease, stress, loss of sleep, throwing out food / moving anyways if unit needs fumigated. I am looking for a new apartment ASAP and plan on keeping access to the PODS unit longer which will incur even further costs.
What is my best course of action here? How can I break my lease at the lowest-to-no-cost here? What is the best legal route when it comes to recuperating my costs and safely exiting my lease given these parameters? Should I pursue a class-action lawsuit?
I am going to interview other tenants with the following questions to legally corroborate and build my case as well as work towards a class-action.
- Name
- Unit Number
- What they have seen / witnessed of the infestations
- How long they have been living here and how the property has previously responded to this stuff
PLEASE help me. This is a nightmare.
