Neighbor’s Cess Pool Is On My Property
Location: Pennsylvania, US
I just learned my neighbor’s cess pool is actually located on my property. I’ve owned my house for twenty years, and heard rumors the last time the other house was sold that they weren’t connected to the city sewer like everyone else here. Houses were built in 1920.
Sellers approached today for permission to dig it up and inspect/pump it out today. I said no, and that a larger conversation needed to be had over the plans going forward. Seller maintains that it’s worked well for the past few years. If it’s in my yard, I know it’s never been pumped or cleaned out (or whatever you need to do to maintain these things; I know very little about cess pools). I’m very uncomfortable with having what could be a big environmental problem on my property. Seller is in a rush to unload this house and I have no idea what the buyer wants or intends to do. I don’t know how it could have sold without having it inspected before by the city, but again, I know little about cess pools.
The seller never occupied the house and knew shockingly little. Our plumbing feeds theirs but they are separately metered. He claimed to know nothing about that either. His wife spent her time trying to sweet talk me into letting them do the work today. I sent them on their way and now I guess I need a lawyer, but I’m not sure exactly what I should be looking for. Would a real estate lawyer be my best option?
