One Med School Evaluator Gives Exact Same Very Low Grade That Makes It Functionally Impossible To Honors A Course. 5 Other Evaluators Have Higher Averages. Assuming Grade Appeals Fails. What Are Legal Options And Would It Be Easy To Prove?
Location: Southern California, San Bernardino County
This is in Southern California. A Certain evaluator on Internal Medicine gives everyone a 70% (lowest possible passing score) on a portion of a grade worth 30%. Honors is 90%. So you lose 9% right OFF the bat, and then you have to literally get 98.8% on the rest of the course which includes hard shelf exams and in person OSCE's which is functionally impossible. I would be SHOCKED to find even a single person over multiple years who rotated under him who got honors
Anecdotally Ive asked at least 15 people who have ALL got the same score on their eval and the known rumor is he gives everyone the same score. This grade will follow you when you apply for residency and if you apply to fellowships. I dont have much faith in the appeals process even though I've filed it.
How difficult would this case be to prove if the appeals case fails and assuming everything I said is factual. Would the school be forced to give the data that proves it? What court would handle this case and would a lawyer even be interested in a case like this?
