Other Driver Did Not File Anything For Car Wreck, Should I Sue?
Location: Indiana
Last December 19th I was in a car wreck that totaled my car and, according to the police report, caused enough damages to the other vehicle where it needed to be towed. From the pictures of the crash and the other driver's lack of action I feel like its safe to assume that their car is still drivable.
I filed a claim through my insurance the next day and have a copy of the police report. My insurance said yesterday that they were waiting on dash cam footage from a third party and for the other driver's insurance to contact them. I called the other driver's insurance today and learned that he never filed anything about the accident whatsoever, so I filed a liability claim with as much information as I could find in my copy of the police report. The other driver's insurance said they will reach out to him for a statement and get back to me.
My question is what else can I do to speed this process along? I need to know how much I can get from a payout to finance my next car and dont know if I should sue for the other driver's lack of action.
