Other Driver Found At Fault, Their Insurance Is Trying To Low-ball. What Do I Do?

I was involved Ina TA, I was at a standstill at a red light, other driver slammed into me. His insurance tried to hold out citing they needed his side of the story even though he was not answering their calls, emails, or answering the tests they were sending him and his mother. He admitted to myself and to the officer that they were at fault.
He gave me the excuse his brakes weren't working and told the officer his foot slipped off the brake and he hit me. He also stated he was going to get his brakes checked (which turned out to be a lie)
Fast forward to the police report, he was driving while suspended in his parents car. His insurance company is trying to offer $3000 to release the primary insured and him from all liability while I'm still dealing with pain, doctors visits and having to start PT. The insurance company had also stated they would pay for my rental until my car is either fixed or totaled out. The body shop is behind by 60 days and stated this to me and them. I do not believe they will supply a rental until that time comes. I feel they will try to low-ball the value of the vehicle as well and I refuse to take their first offer while I'm still dealing with daily pain that is impacting my home life and my job.
What do I do in this situation?
