Pa - Non-compete From Daycare Job, Can It Prevent Me From Taking A Public School Teaching Position?
LOCATION: PENNSYLVANIA
Hi, I’m looking for some general guidance on a situation involving a non-compete agreement.
I recently started working as a lead teacher at a daycare/preschool (nonprofit) in Pennsylvania. I’ve only been employed there for about 2 weeks, they have be “training” for the daycare, but I have not yet started the actual school year
I’ve since received an offer for a 2nd grade teaching position, which is in line with my degree and long-term career goals, and I plan to accept it.
However, the daycare required me to sign a contract that includes:
- A 120-day notice requirement
- A non-compete clause prohibiting me from working within 10 miles for 1 year
I am not opening a competing business or soliciting any families — I would simply be working for a separate elementary school.
My questions are:
Are non-competes like this typically enforceable in Pennsylvania, especially in early childhood education?
Could they realistically take legal action against me for leaving after such a short time?
Does moving to a K-12 school even count as “competition” in this context?
I am mainly concerned about the possibility of being sued or facing legal consequences.
Any insight would be appreciated.
