Parents Died Without A Will, Feeling Bullied Into Signing My Share Of Inheritance Over. [maryland]
Location: Maryland, USA
I know estate questions are a dime a dozen but I feel I have a weird and precarious situation on my hands.
for color, grew up in narcissist family, became scapegoat, recently reconnected (or so I thought) etc. before both parents passed away. my brother (11 years older than I) has lived in the family home since childhood and never left because of his severe obesity/neuropathy that makes it so he cannot work. I myself temporarily moved in about 6 months ago before making my big move across country.
we both split utilities equally as that felt fair but I have been contributing half to the house taxes and homeowners insurance as well, on top of paying my deceased mothers car loan and insurance out of my own pocket. (I know this was a bad call now) from the beginning he has asked for the home claiming it was my mothers wishes, which I was fine with, but he does not want my name on the deed as he is low income and can receive tax credits supposedly.
we’ve been butting heads since I temp moved in and today it came to a really ugly head after a disagreement, with him insulting me and holding it over my head that “at least he doesn’t charge me rent” despite not having any way to enforce that?! lots of claiming I am taking advantage of him because I said it didn’t seem fair I was covering half of everything plus ownership costs AND the car. he has also repeatedly driven my mothers car every day for months while I continued paying on it and refused to help pay for the tag renewal despite this, suddenly after I called him out he began driving his own vehicle again.
I am exhausted. I cannot afford an attorney. we have an appointment this thursday to sign second/final account and consent to distribution. I do not want to just sign away my rights but I am having trouble deciding on next steps. (even our register of wills auditor was asking me if I was really sure I wanted to sign it over) on one hand it feels best to let him have it all and never speak to them again, but I think I’d be setting myself up for failure. on the other, he is very permanently disabled and cannot work, therefore he would likely be homeless if there was a forced sale of the home. he cannot afford more than the utilities he is paying now.
I feel like I am facing both a legal and internal moral battle and I am so overwhelmed. any advice would be much appreciated. I have to figure something out prior to Thursday as I am leaving out of state Friday. that adds further complications as the office seems to insist on in person appointments.
if there’s anything I can clarify please do let me know. thank you.
TLDR: Appointment to sign second and final account and consent to distribution this thursday, brother and I both live in the family home (him permanently, me only for a short period and moving out of state in a few days) feel bullied into giving him the house and me “taking the car” but unsure of future legal ramifications and expense for me.
