Predatory Company Threatening With Lien. What To Do?
I'm in:
Location: Florida
I had a water leak from another apartment a few months back. They were doing work in their apartment and broke a water line.
They had insurance, which covered me since I was one of the parties affected, though my damage was not very extensive.
The called a company for emergency services to dry everything.
The boss told me I would get documents in my e-mail to sign and to just keep signing what comes.
Now I know you should never sign documents like this, but it was an emergency so I was panicked and just signed everything.
Later I learned that it was a predatory contract. They would basically get all the insurance money sent to them and I would be forced to use them to fix the damage once the insurance settlement was paid.
A clause in the contract even said if the insurance did not cover everything, I would be responsible to cover the difference.
Now obviously, such a contract would not stand in court, so I fired the guy, I told them they can't touch my property anymore, and I told them to negotiate with the insurance to get paid for the work they did. I informed the insurance adjuster of all this.
Now I got a "Notice to Owner" letter threatening a lien. A friend who knows a lawyer who deals with this says they are bluffing, but I'm not sure.
I don't want to have a big lawyer expense. Should I wait to see if they actually follow through with a lien, or should I contact a lawyer? I read it is possible for me to wait out 90 days, whereupon a lien would not be allowed. So would need to wait and see for a few more weeks.
Any thoughts?
