Re: Protestors Trespassing On Property

Card image cap

It has been two weeks and this complaint has changed.
Location: Lake County Illinois

2 weeks ago I posted about how the police have allowed protestors to trespass on my property. They left last week and I have been spending my time trying to find answers. I finally found some.

The police were acting at the guidance of the first secretary of the Lake County State's attorney to declare my property public land without any formal process. The first secretary was in contact with the legal representation of the the union protesting on my property and was using the Lake County Recorder GIS map rather than my plat of survey to determine my property boundaries. The first secretary claimed that there was ambiguity, however I asserted from the beginning that it was my property and proved it with the plat of survey. The land in question is the 40FT build line from my fence to the street, it is clearly labeled as a building line and not a public frontage or public easement/right-of-way.

I have requested through the FOIA for documents related to my property and I've been pretty much sandbagged in getting anything from the city (over 10 days since first request). I have been told by the first secretary that if I want any more information regarding the incident I have to set up a meeting with them.

What can I do to reestablish my property rights and protections? If I need a lawyer, what kind of lawyer?

update

I spoke with an eminent domain lawyer and he explained that I can take the issue to my title insurance company who should enforce my property lines. otherwise I can contract them to try enforcing my property boundaries, but it's likely not a very fruitful lawsuit and I might not have my lawyer fees refunded if I win.
