Real Estate Law- One Seller Refuses To Sign At Closing

I’m in a bit of a mess right now where I am trying to purchase a short sale property, and after a long 60 day closing period, we finally had all green lights and signed our closing documents on Thursday. Thursday evening though we get a call from our realtor that apparently the husband of the elderly couple that own the house refused to finish signing the closing paper work at the title company. They have since moved to a nearby city so we closed at different locations.

From what I was told there may be some dementia involved. There were some items they were going to leave behind in the garage that we signed a personal property agreement for several weeks ago that now the husband was saying he wanted some of. On Friday I said okay fine have him write a list out and he can come get them within 14 days. It was some minor items like a boat anchor and set of longhorns. We and the sellers wife all digitally signed that amendment, but he still refused to sign.

Our realtors lawyers sent a demand letter Friday requesting he sign by Monday end of day or they will initiate a lawsuit.

My main question is this: if he still doesn’t sign Monday, do we still have a chance of getting the house in a reasonable time period? Or is the legal process so long and tedious, or uncertain if we could even get the closing court ordered, that we should just forget it and move on?

Any advice or similar experiences would be appreciated!!
