Rear Ended And Now I’m Being Sued

Card image cap

Location: GA, USA

This occurred in Georgia on a state road (express lane).

I was rear ended in the express lane when traffic came to a stop. I was hit hard enough to push my half ton truck into the vehicle in front of me. The vehicle in front of me was hauling a small u-haul trailer. I was hit by a midsize SUV.

The driver of the SUV told the police and insurance that I hit the trailer first. I told the police and insurance she hit me and pushed me into the U-Haul. Obviously I know what happened, and I was pushed into the trailer.

The police took her side and created two accident reports, stating that I hit the U-Haul trailer first and then she hit me.

Now, just heard from insurance that the lady is suing. I honestly have no idea what grounds she has. The police report is about the only thing that supports her argument. My insurance is saying she is 100% at fault, but her insurance is saying 50/50. I got assigned a new adjuster because now she’s personally suing.

I can’t post photos, but a breakdown of the damage to all vehicles:

Vehicle 1 w/ U-haul: trailer door pushed in. Vehicle towing was fine. No injuries. Drove away.

Vehicle 2, my truck: no airbags, crushed rear bumper, crushed rear frame, light hood and bumper damage, drove away but deemed totaled because the frame was crushed

Vehicle 3, claimant: airbags deployed, front end severely damaged, leaking fluids, towed away, definitely totaled

These police reports that are incorrect are what’s hurting me the most it seems. The vehicle damage just doesn’t add up to what she’s trying to say and sue for.

What do I do? Now I’m panicking and wondering if I need legal even though my insurance says they’ll assign a lawyer if necessary.
