Receiving Inheritance During A Divorce

My childless, unmarried uncle died a few months ago after a long illness, and his will divided up his property between me, my brother, and our cousin (not deceased uncle's kid, cousin's mom was the deceased's sister). I am the executor of uncle's estate, which is essentially just a savings account and checking account with a combined total of around $60k. The will states the assets are to be divided equally among nieces and nephews: so me, my brother, and our cousin (uncle's niece).

Once the money is released to me, I assume I then distribute the shares to the other two. The issue is: my brother is undergoing a divorce, and is worried that if he receives his third of the inheritance right now, his ex will get half of it. Is that true? If so, if I were to hold on to his portion of the inheritance and essentially just drag my feet in distributing it to him (with his consent), would that be illegal in any way? My brother's divorce started before our uncle died, and he didn't know about the inheritance until recently, if that matters.
