Rented Our Home Out. Now Tenants Are Trying Everything Possible To Avoid Paying Rent.
My wife and I were having a hard time keeping up with the mortgage but wanted to avoid selling if we could. We had the opportunity to stay with some family and decided to rent out our home. We were able to rent out the home for more than what our mortgage cost.
The tenants that moved in have tried everything possible to avoid paying rent after the first month. They have claimed so many different things justified their withholding of the rent. We have made repairs to most problems that have been presented. However, they keep trying to find something else. Now they have had a city code inspector come out to try and find any other issues with the home that they can use to not pay rent. We are now stuck trying to cover the cost of the mortgage anyway.
They have had several violations of the lease themselves. The security deposit never went through and they are refusing to pay it until the repairs are made. However, once the repairs are made they still refuse until they find something else.
I am worried we are being taken advantage of but not sure what we can do about. This is out first time renting our home and we do not know how to proceed. We have spoken with a local attorney but he wanted a $5000 retainer and we can't afford this. What are our options? Can I proceed with an eviction on my own?
We would appreciate any advice.
