Excessive Force While Cuffed?

Card image cap

Some time ago my neighbor called the sheriff's dept on me after i got in an argument with a relative.

Dept showed up and knocked on the door.

They said they were their because of a noise complaint by the neighbor.

I stepped outside and talked to them about the noise and apologized for the loud argument.

They asked me questions and I explained that my relative had gone to work.

I wasn't shouting or hostile at all.

They then asked for his phone number.

I asked them why they needed a phone number.

I talked to them for a few minutes and all of a sudden they started to pull me out.

They never said anything and cuffed me and put me up against the wall.

Then one of the deputies tightened my cuff, grabbed my arms and slammed my face into the wall scarring the right side of my face.

I cried out and asked the deputies why my head was slammed.

I asked many of the deputies that day why he slammed my face into the wall while I was handcuffed.

Two of them looked at me and shook their heads.

Then the one who slammed my head into the wall started to forcefully lead me outside.

Then he "fell" and dragged me down with him leaving more injuries.

My left foot with the pattern of his boot was bleeding, my left knee was bleeding , my left shoulder completely scarred from the asphalt and my left head was scarred too.

Then he picked me up and put me in the car and said he needed to check inside and he entered.

I was charged with obstruction w/o violence and the charge was dropped six months later.

I never made a court appearance and I was offered DPA many times.

The public defenders office said they knew who this deputy was and that they dismissed many charges after interviewing him.

I sent in complaints about the arrest and the excessive force and got a response that obviously will not talk about the face slam.

I have photos of the injuries I got that day.

Do I have a case?

They came because of a complaint about arguing.

I answered the door and talked to them calmly but the phone number threw me off and I asked why they needed it.

These injuries were mainly scars but the fact they were done seemingly so deliberately knowing I was cuffed is what makes me think I have a claim.

Location: Florida.
