Rewards Program Sales

So this question is more understandable if you go to Chuck E Cheese, but there is a rewards program the company has called fun passes (Gold, Silver, Bronze):

  1. Gold 12 month commitment at $29.99 a month or $159.99 for two months, does not auto renew.

  2. Silver $11.99 a month annual, $96.99 for 2 months

  3. Bronze $7.99 a month annual, $62.99 for 2 months

When customers come in and buy stuff, they always ask for phone numbers regardless, but they are also required to push the Fun Pass. Most ring up the order and figure out if there is a reduced cost on the order if they were to purchase one of the fun passes and then give them the option. One person just includes the fun pass and then tells the customer after that they were able to reduce the cost by including the fun pass after purchase without giving the option of saying yes or no. Also its a commission for the person selling.

Training will be had to correct this, because it seems unethical, but i would like to know is it an illegal tactic?
