Running Out Of Options, What Do I Do?
Location: Collin County, TX—Our home backs up to another residential property, with a drainage ditch running between the back-to-back lots. The ditch was originally natural but has been significantly modified over the years and now receives stormwater from an engineered outfall draining roughly 65 acres.
The erosion has become extreme—our fence line is pretty much gone and the bank is now only about 15 feet from our property/house area.
The City says it’s private property, so it’s our responsibility, and also points to TxDOT because TxDOT originally constructed the road/drainage system. However, TxDOT later transferred control, maintenance and jurisdiction of the road back to the City. We’ve also found no drainage easement across our property.
We have an engineer and attorney involved, but we’re basically stuck footing the bill for remediation while the city is getting away with it. We can no longer afford it and our remediation will only hold temporarily. We’ve been given a rough estimate of ~$150k.
Anyone dealt with something similar or know what else we should be looking into?
