Should I File Civil Suit Or Press Charges To Get My Property Back From A Repair Shop That Stole It? [florida]
So about 8 months ago I took my ps5 to a local repair shop for repairs and then after a couple months the repair shop owner kept delaying my pick up date. Eventually they ghosted me altogether and I even asked to pick it up without repairs.
In total the ps5 is worth about $750 new and I paid them a $40 diagnostic fee initially so this would definitely be small claims.
I saw on their sunbiz LLC registration that the LLC is inactive and it says "Admin dissolution for annual report". Also they registered their business address to a ups store, maybe a PO box. But their home address was listed as a previously registered address to the LLC. I also saw he had 2 recent google reviews 1-2 months old about this similar scenario happening to other people.
All that to say I filed a police report and my local police department said they are willing to press charges. I initially declined to press charges because I just want my property back mainly and him being in jail might slow that down. I am wondering which option is best to pursue and if I should do both and what order should I do them in etc. I already got the police report in order to help me file my civil suit.
Also any tips for small claims civil suit would be appreciated.
