Smart Watch Gets Take From Our 7 Yr Old During Gparent Visitation
We, the parents and married…and have full custody, have gotten a smart watch for our daughter. There is a 4 yr old visitation order in place with the estranged in-laws and she has to visit them once every 8 weeks and have a FaceTime call with them for 30 mins once a week. We do not trust these people, and they took away her smart watch the last time she went there, but also didn’t answer the 7 pm call that is in the order on Saturday and we had no idea where she was or if she was okay until 11 am on Sunday the next day. We were very close to calling a welfare check for her because of the lack of communication. My question is …do we have any legal recourse to her being able to keep her watch on while she is there? I am well aware that it is not a distraction for her, but more of a comfort thing…having the ability to call us whenever she would want (really just having the option to), without even necessarily contacting us. Just the idea of her being able to is soothing. She has expressed multiple times she does not want to visit, does not want to talk to them. We know that a judge or a court might not listen or change the order for a child of her age. But I question that as well because she has expressed herself very clearly about this. She even plans to bring her smart watch this next time and hide it from them because of her experience last time (her idea). There are no provisions in the order about personal items, but my question would be how can we make sure she can keep it on, and we can assure her well being should contact not be made at even the court ordered time for calls. This caused a lot of stress the last time she went. Location: North Carolina.
