Someone Hit Me In A Car Accident Almost 2 Years Ago And Is Suing Me

Card image cap

Location: Los Angeles

I was driving on a main street and the other driver going in the opposite direction made an unprotected left turn in front of me. He was turning onto a neighborhood street where there are no traffic lights or stop signs at this intersection. He cut in front of me as I was passing through and the front right side of my car ended up colliding with his back right side of his car. Nobody suffered any injuries and walked out of the accident untouched.

Took it to insurance and the guy tried to make it seem like I rear ended him. But after arbitration, insurance decided that I was not at fault.

However, almost 2 years after the accident, I just received a letter saying that I am being sued by the other driver for personal injury in an unlimited civil case of over $35,000 - claiming he has suffered wage loss, loss of use of property, hospital expenses, property damage, and loss of earning capacity.

Also on the documents I received, they put the date of the incident incorrectly- they put 2025 but the actual date was 2024, not sure if this was done intentionally to avoid the statute of limitations in CA?

Any accident attorneys with advice on next steps? Or how likely I am to win this case?
