Tenant No Longer At Premises And Has Not Paid Rent, What To Do With Their Possessions?

Card image cap

Location: Orange County, California

I am the son of the landlords, being my parents. They mostly speak Vietnamese and so does the tenant. I am asking on their behalf. Unfortunately, the lease was not written and mostly managed orally and through vague text messages.

Tenant has been here almost 2 years. On August, they got hospitalized and are no longer staying with us. Tenant paid for the month of August and September. They have not paid for October and Novemeber and have no plans too. After getting some police involved we are in contact with the tenant and her daughter.

Around September. After some arguing between my parents, the tenant, and her daughter, we were told that the tenant's family would pick up the tenant's items and possessions. They initially picked up the tenant's car, but they are dismissive about our attempts to reach out to them about picking up the rest of the tenant's possessions.

Side note: My dad also has a written agreement, signed by the tenant, that the tenant's daughter is now responsible for the tenant's items and that the tenant and their family can't sue us, written in Vietnamese. I dunno how helpful that will be or if its legally binding.

I have done some basic research and understand that the lease has been terminated due to "Abandonment and surrender of the premises". We are wondering if we can take legal possession of the tenant's belongings now so we can throw them away and clean the room to prepare to be leased again. I explained to my parents about the legal eviction process and they understand it but would rather not deal with the waiting and fees.

Is there anything we have on them and can we just take back the room? If theres any important context needed I can answer it.
