To Sue Or Not To Sue -- Easement
LOCATION: South Carolina
I was recently given an acre of undeveloped land by a family member. The property is landlocked. I must cross 3 individual properties before getting to mine. There is already a road being use to access 3 other houses near my property. The road cuts off right before my property but one of the homes is using the front of my property as their driveway. The road is on a survey but its considered a private easement/driveway. The property owners don't want me to use the road simply because they want to control who lives on my property. I grew up in the neighborhood so I'm familiar with all individuals involved. Was actually quite close to them until this issue came up. I've tried sitting down talking with them but no luck. They told me its business not personal. Although our relationship is severed I'm still on the fence if I should sue for an easement by necessity. I meet all requirements under SC law for easement by necessity. I also would not need to make any changes to anyone's property except my own. So it's either sue or sit on used property.
