Trailer Moving Company Hit My Mobile Home
Hello, apologies for any mistakes but I'm quite new to posting to reddit and someone mentioned this would be a good place to go as I'm not sure it's worth even taking to a lawyer or not.
I'm 28(NB), location: Maine, USA. I'm not sure exactly where to start but here are some basic facts:
I'm putting a single wide trailer home on my parent's property. I have already paid for and have had set up the septic system as well as the pad which is set up to the specifications of my trailer.
The trailer is a single wide I bought from my parent's friend, the purchase was made I believe in October but my memory on that is a little fuzzy. It is currently still at that person's property on this date (1/8/26).
The original date the moving company promised to move my trailer, without any sort of written contract, just word of mouth via phonecalls, was November 25th, 2025. The owner of the business explained on November 24th that he ran into issues with a different client and had to change days, move it November 26th instead. That never happened and continuously the date was moved further and further back.
I was getting ready to say never mind, we'll move it in the spring, it's obviously been snowing and sleeting and causing a mess of the roads and driveways but then I received a call the 27th of December, 2025, saying that they were going to come that following Monday (the 28th) to move the trailer, weather depending. The weather was bad so they haven't given us another date they want to move it.
So far this company did for free: Winterize my trailer's pipes for safe transport and so they wouldn't freeze during the winter regardless (something they claim to charge $350 for). They also claim to have used some of their own steel without charge to weld the frame to be more safely transported though it's still unclear what was free and what is to be charged.
I was woken up by a phone call Tuesday the 6th of January by the man who owns the business. He explained that one of his guys went there yesterday to finish up some welding (even though he'd already told my mother 2 weeks previously that the welding was finished) and supposedly the whole area with the trailer was straight up ice that caused him to slide and hit the trailer. I was trying not to get hysterical because he admitted to some real damage and the truck had knocked my trailer off it's supports. He also tried to claim the wood was rotted and I can't make any sort of judgement calls to that but I was told by the friend and the wife that it is not rotted and I feel as though I can trust the friend a little better since he no longer has a stake in the situation, what with the house being paid for already. I listened to every thing and told him I had to talk to my parents about it before doing anything at all.
Currently I'm living with my parents while trying to figure this whole thing out. My mother had received a call from her friend we bought the trailer from and had been told that the friend's wife her a loud bang from their house next door and came running out to see what had happened and to take pictures. Reportedly, the guy who hit my trailer started yelling and screaming at her when she asked how fast he was going so she left for her own safety.
The wife sent pictures to my mother of the house and the front of their truck and both the friend and his wife claimed it was in fact NOT icy at all. He'd been plowing the area around the trailer quite thoroughly though I personally cannot attest to that as I hadn't been to the property in that time and couldn't make it the last two days.
In the original phone call with the owner, he said he would 'pay for the trailer' after promises of fixing it up 'better than new'. Again, I didn't say anything as to what was going to be done, hadn't said anything was decided before I hung up to discuss with my parents. After more conversation, the owner clarified that he would fix up the hole and if we didn't approve of the job, that he would buy the trailer for what we paid for it.
The trailer is admittedly old, made in 1983 but it was in decent enough shape from what I could tell during the walk through and it would last me for what I wanted for the time it would survive. My father and the friend think I should just let him buy the trailer for the same price I bought it but the problem is we have already done the pad. Finding another trailer for anything close to the same price that has a very similar if not identical plumbing set up sounds quite difficult and while I love my parents and the other family I'm currently sharing a double wide trailer with, I need OUT of that damn house. I have also stated that regardless, I want to have a third party, unbiased home inspector to take a look at the house.
My questions:
Do I have any real legal recourse, is it worth bringing to a lawyer?
Is there anything that I can really do in this situation?
My mother thinks he just wants to bypass his insurance, is it wrong to take the payout?
I don't want to live in an unsafe house but my mental health is on the actual edge and trying to find another trailer to fit the pad and plumbing has me in a total freak out, I feel like I'm drowning and there's no good answer that lands me in any good place. Any help is appreciated.
