Ttab Extension For Opposition
Location: San Francisco
Hi folks, we are a delaware c-corp startup filing class 43 trademark for our company name, but a fortune 100 company that everyone knows just hired a top 10 IP litigation lawyer to file an extension for opposition at TTAB. We checked TTAB recent records and noticed everyone this particular lawyer filed TTAB extensions to had their trademark status abandoned… now they sent us a letter mail to inquiry our application, what do you think we should do? Ignore? Respond? (So far we are completely radio silence)
Additionally, we have obtained class 43 in a foreign jurisdiction already which the counterpart corporation also has a tremendous amount of businesses in.
The lawyer listed their bio as specialized in IP litigation and acquisition, but also experienced in corporate acquisition. But they didn’t approach us with a cease to desist or cc’ corporate development for acquisition, instead they only said “amicable solution” multiple times in their letter.
So genuine concerns? M&A? Pre litigation?
Since it’s literally our company name, we will definitely fight til the end unless it’s an M&A for the entire company. Do you think a powerful fortune 100 conglomerate will ever backdown from TTAB?
