What Is Considered “reasonable” When Referring To Suspicion In A Traffic Stop [tx] (also Posted In Askalawyer)

Hi, I’m not sure if I should be posting in here or r/askalawyer but I have a few questions about a traffic stop -> arrest that just occurred. And before anyone asks: yes, we are retaining legal counsel. This post is just to assuage my fears until our consultation with a few firms.

Location: Texas

My partner and I were pulled over after being followed from a vape shop (where we bought sealed, nicotine only vapes). The initial reason given for the stop was he plate came back that he had no insurance (false, and my husband disproved that immediately). The officer continued to fish and saw my makeup palette. The palette in question was being used at the time and was very evident that it was JUST makeup. Then the officer pulled my partner from the car and stated that the reason he was pulled over was his front plate (even though he was behind us the whole time). He pulled me out and told me that the image on my makeup palette that was purchased from a national brand (it was not a custom made or blended formula to include anything, it was purchased in store - off the shelf) and the fact we were dressed up to go to an EDM show gave him reason to believe he should search the car.

Long story short, the K9 handler they brought to search the car said we’d probably be sentenced to a year in state for the charge of >1g of mdma (which they labeled as meth).

Both of us are first time offenders. If the cop was just trying scare us, he did a good job with me because I’m terrified of going to state. The last time either of us even got so much as a speeding ticket was years ago.

My question is: is EDM music and the picture on a store bought makeup palette considered reasonable suspicion? Can the officer continue the stop after the initial reason for the stop is disproved by changing it to a different reason? What is the likelihood of us going to state?
