Who Lays Claim Over Ownership Of Item.
Location: Michigan.
A co worker gave me a car battery months back when mine died, when he gave it to me that was just it. There was no set expectation at the time of payment or anything making it conditional, I was under the assumption that it was a gift especially since it was dead anyways.
Went on and got an exchange through warranty, but it was expired and I had a friend who worked there do it anyways. All was well for about 2 months or so and then his wife’s car battery died, and he told me it would help out a lot if I gave him $150 for him to buy a new one since he gave me his. Didn’t have the money to help him at the time so we just kinda went on. Month or so later, which would make it this week we had an issue at work and now he’s claiming it was a loan and there was expected payment, and that I’m to pay him the full $450 now or he’s taking me to small claims court over it.
To my understanding, there was no expected payment when he gave it to me, and the battery that was originally handed off, couldn’t hold a charge. With this being said, do I actually hold legal possession over this? Or should I just find a junk one to give back, since that’s what he did in fact give me. I don’t think it’s fair he can give me a junk one and get a brand new one in return. That just doesn’t seem fair, especially since I was under the impression that it was a gift for a few months until stipulations were made.
