Wife And I Going Through Divorce
I'll try and keep this as simple as possible so bear with me, I hope I picked the right flair.
Location: Maine
Wife and I are separating, mutually agreed and keeping things as amicable as possible between us while I file the paperwork. No lawyers involved.
No kids but we do have one property we bought together back in 2018. My main question is, would a judge accept a written and signed statement from the both of us basically stating the only asset or debt we want accounted for and split when we file is the house? In Maine the papers we need to file are calling for several years worth of bank statements, retirement account statements, tax returns, etc. I'm trying to keep it as simple and as expeditious as possible.
The statement draft I have so far is this
"Both parties mutually agree that the only asset, debt, income, and all other monetary variables to be involved with the divorce will be the property of [property address]. The property will not be sold, instead the current outstanding balance of the existing mortgage will be subtracted from the appraised value with the result split in half to determine the value to be awarded to [OPs name].
The property will be refinanced through a financial institution chosen by [OPs wife] and be placed in her name only."
Would a judge accept such a statement or would I have to start tracking down statements?
