[nc] Auction Place Thinks I Am Someone Else And Not Giving My Money Or My Car

I am a licensed dealer and recently purchased a vehicle from Manheim, which is one of. the biggest car auction places in the US. Car dealers are have to meet certain requirements in terms of location so it is very common to takeover someone else's lot once they vacate it and/or go out of business.

I started my lease a few months ago and am registered with the state of secratary, IRS, DMV and all auction places.

Manheim got me mixed up with a dealer who operated at the same address in the past and claim that I owe them $17k. The ONLY purchase I have ever made through them is around $8500. I found out about this after I made the payment for a vehicle I purchased. Now they have my money and my vehicle and are not releasing either one of them.

The dealer they think I am and I have,

Different TAX ID numbers, different social security numbers, different LLC names, different drivers license numbers, different names, different dealer numbers which the DMV assigns you after you complete the mandatory course and fill out a bunch of paperwork and they do a background check on you. They ONLY happened operate at the same address prior to me.

When I question them they claim that we have the same TAX ID which is impossible. I asked to talk to someone from their legal department but they don't connect me to anyone. The credits and collections department made up their mind about us being the same company, which we are not.

At this point they are holding my purchased vehicle and have my check. I am planning on taking them to small claims but wanted to check if I should be doing anything else.
