Will Family Land Go To Our Dads New Wife?

Card image cap

Location: Texas.

Writing on behalf of my husband.

A few years ago, my father in law completed his first will since he was having big heart surgery, where he was assigned his assets to his children, those of which involve vehicles, firearms, and 40 acres of land.

He’s a bit of a recluse and got married to a new woman less than a year of them dating. He did not listen to any of our advices to get a prenup, and the entire family is terrified of this woman stealing the land from him. He is not a good man and will lie cheat and is verbally abusive. We question why she stays but we theorize it’s because she is waiting for him to die to keep the land for herself and her own children.

Does their marriage Trump the will that he put into place? The Will specifically states the land is to be divided amongst his two children. Since they got married, they ended up building a home on the land so I know that Merkey’s up the waters even more.

Not sure if relevant, but my father-in-law and mother-in-law purchased this land while they were still married and as part of the divorce decree, he had to promise this land would go to his children so that his first wife name could be removed from the deed.

If our father-in-law dies, could she potentially get the land? This has been in their family for over 100 years and is a small section of a bigger portion of land.
