Work Suddenly Requiring A Neurologic Clearance 2 Years After A Concussion

Card image cap

Location: Michigan

I am a DOT employee. 2 years ago I had a workplace injury resulting in a concussion. I was out on workman's comp for a few months, and after getting cleared to return to work I have been working without issue for a year and a half.

Last month I had to renew my DOT health certificate and was fully cleared. However, my company works with Hire Right, a 3rd party company that assists with background screening, drug tests, and making sure all drivers are in compliance. For some reason this year Hire Right is requiring me to get neurological clearance, and I'm expected to pay for it. Last year I had no issue renewing my health certificate post-concussion.

I have had no incidents at work. I have a perfect driving record. I'm repeatedly told I'm one of the best drivers we have. I have been working without issue or question this past year and a half. Suddenly being required to prove that I'm not disabled raised some red flags for me. Am I wrong in thinking that a Fit For Duty exam based on medical history alone is in violation of the ADA? Even tho this is a safety sensitive position I have more than proven that I am fit for work.

The management at my job location thinks this is inappropriate. They aren't the ones who are requiring this of me, it's corporate and Hire Right. Management knows I'm a good and perfectly capable driver, but they're acting like there's nothing they can do. I'm currently on office duty until cleared. What do I do?
