Wrongfully Terminated?
This is a bit of a long spiel, but I feel all the details matter in my situation. If you take the time to read everything, thanks.
Location: Washington State
About a week ago, I was terminated from my job for an hour of suspected time-fraud. Management there absolutely sucks, but the work was easy, with great pay and benefits, and a lot of friends I made over the few years I was there. My partner got a job there a some months before me, so working with him was also a huge plus. When I was hired, I made it clear that my partner and I had to work opposits, because we have a toddler. I was told this would be no issue.
Things started 2 weeks ago, when I was pulled in for a fact-finding meeting. The union delegate I wanted with me was not able to attend on the original meeting date, and when I told my manager, he tried to push for keeping the meeting the same day and time, saying the HR rep was busy the rest of the week and that it wouldn't take long anyway. I kept saying I'd be more comfortable with a union rep, and he eventually rescheuled for later that week. When the meeting happened, I was being accused of suspected stealing. While reviewing surveillance footage from cameras that were recently installed, he claims he saw me go to the cafeteria before they opened, and never go back to pay for whatever I took. I said I grab a soda before they open because I'd be too busy to get one later if I waited, but that I ALWAYS go back to pay. I even mentioned getting manager approval the first time I did it, and just continued to do it after that. Was then asked if I could get bank statements to prove I paid, and after the meeting, that was the first thing I did. Pulled up a bank statement showing transactions for each day he accussed me of stealing, so that was dropped.
Second point for the meeting, he says I adjusted my time-sheet for a week in early February, the same week I was caught "stealing," giving myself about an extra hour. This is not something I ever recall doing, nor would even think of doing. I was honestly in shock, and didn't know what to say, aside from, "I don't know what happened. Maybe I forgot the clock-out time when adjusting it to add my lunch?" There was one day that week where he says he saw me leave, and my clock-out time was 30-40 minutes later. This REALLY baffled me, and I of course had no memory of something that happened a month prior. When the meeting concluded, no resolution was met for the second point, and my union rep told me it would be about a week before I get pulled in for another meeting to conclude this one.
A week later, I'm told by my manager that I have another fact-finding meeting after the weekend. I was stressing out right away, because he he said it was another fact-finding meeting, and not a meeting to conclude the first one. I told the union rep, and he said he would be able to delegate for me again. Come the day of the meeting, I get a message from my union rep that he won't be able to be there because he was getting pulled into something else, but that another delgate would be there. I said I would be more comfortable with him, but he insisted this guy would be a good representative, but if I wanted, I could try to reschedule the meeting.
I should have followed my gut feeling and rescheduled to have the union rep I wanted.
My new union rep called me about 45 minutes before the meeting, saying he had another meeting to attend in 15 minutes, and that he might be late for mine. Minutes before the second meeted started, I was scrambling to find where my union rep was, and was told by my manager to hop in the video meeting and we'd wait for him. A few minutes into waiting, he says we'll just go ahead and get things started in a couple more minutes because it won't take long. Thankfully, my delegate showed up a minute later.
With the second meeting started, my manager said that after I mentioned adjusting my time-sheet to add my lunch at the last meeting, he reviewed that week more, and is now saying I just didn't clock-out that whole week because he saw me walking right past the badge reader in our department. At that point, I knew exactly what was going on. I told him I clock-out on the first floor, and there are some days I forget to clock-out until I get to my car, so I have to walk back into the bulding. His response was that we are only supposed to clock-in and out using the badge readers in our department. This is when my delgate finally spoke, saying, "But what if I'm running late? If I'm running late, I'm going to clock-in using the first badge-reader I see before rushing to my department." My manager replied with saying it's still not allowed, because someone can clock-in 10 minutes away from their department and the time it takes to get to where they need to be, according to him, is time-fraud. The badge reader I used to clock-out those days is less than a minute away from the one he's saying I should have used. As for the day with a 30-40 minute difference from when he sees me leaving compared to my clock-out time, I'm fairly certain I took my lunch at the end of my shift, because I wasn't able to take it earlier (this didn't come to mind until after I was fired, so was not mentioned in the meeting). Things concluded shortly after that, his only evidence being video footage of me walking past the badge-reader in our department, and my time-sheet reflecting a few minutes later on a couple days, and 30-40 minutes later on a single day. About 3 hours later I was fired.
Why I feel I was targeted: 1. Anyone that's been there longer than me knows of another worker that was caught commiting ACTUAL time-fraud (would leave hours early and clock-out from home), and he still has a job (they adjusted his schedule to work better for him). 2. The reason for how the time-fraud was commited changed from me adjusting my time-sheet to me using a badge-reader in another department. I see more than half the department use the one I mentioned using, and if you watch the night surveillance, I guarantee you'll see a lot of people walk right past the one in our department, and their clock-out time will be 10, sometimes 20 minutes later (they wait downstairs for their shift end-time before clocking-out). So, according to him, they are all commiting time-fraud. 3. He tried to get me to start both meetings without a union rep, when he knew I wanted one there, and he knew they were serious accusations against me. I feel like he was trying to corner me on my own, banking that I'd say something to screw me over. 4. Friend at work asked another manager why I was let go, and they were told because I was caught leaving campus. I've left campus twice in my 3 years there, and both times with manager approval. Not sure where this rumor came from a day after I was let go, and the only person she would have heard that from was my manager. 5. Making the schedule with my partner and I was probably a pain, especially right now with multiple workers on FMLA. Manager would constantly schedule us shifts we couldn't work together, so we'd have to ask him to fix it. Some days would be short a worker because of this, putting strain on either the morning or night crew, making managers have to step in to help. He was also known for scheduling people to work 5-8 days straight between pay periods, so no OT would be given. When I caught on to this, I told him to not schedule me more than 5 days straights. He would have to fix the schedule every time he did this for me, because I'm not working 5 days straight without OT. 6. Manager refused me a promotion for over 2 years, hiring new people as the status I wanted without offering it to me first. He knew I wanted this postion, but always had an excuse to keep me from it. 7. I bitched to this manager a LOT about other employees not doing their jobs, and even went above him a few times because nothing changes after talking to him (possible write-ups on him).
One of my friends that says I should pursue has linked me to some pro-bono attorney offices, and I'll most likely fill out their online form for a free consultation. Again, just looking for validation from strangers on the internet that I could indeed have a case here.
