$50,000 Auto Loan Funded, Dealer Stopped Delivery, Money Now Unaccounted For.
Location: Colorado & Georgia
I’m physically residing in Colorado buying a truck from a Georgia dealership. USAA sent $50,000 to an account/routing number the dealership provided/itself confirmed via a dealer funding request. The dealership then stopped the truck’s delivery mid-transit (photo evidence, confirmed with driver for delivery date and time).
Over a month later, I have no truck, the money remains unaccounted for, and the USAA loan is collecting interest.
The dealership (all in writing) says its bank can’t find the funds for the past 30 calendar days!!! USAA’s recall request hasn’t resolved anything even with a Tracer # for the ACH transaction which shows received by Chase Bank & processed according to USAA. No response from Chase Bank for 30+ calendar days!!!
I suspect fraud now and am moving all my accounts/products/services from USAA elsewhere after over a decade of services. I have signed contracts, funding instructions, and written communications and am at a loss for words…
What kind of attorney handles this, should I hire in Georgia or Colorado, and how do I protect myself from payments and credit damage while pursuing recovery? WWYD?
