[ms] Insurance Agency Dodging Answering Victim’s Attempts To Contact In Order To Toss Out Claim, Do We Have A Case?

Not sure if the flair’s correct but my roommate was involved in a minor traffic accident some months ago. Someone sideswiped her which basically caved her driver’s side door in enough that it grinds against the chassis when she opens it. While the perpetrator gave his insurance information without issue, the agency (Farmer’s Insurance) has consistently been giving us the run around for the better half of 2026 at this point.

After months of silence despite my roommate’s attempts to call, text, and email them (with receipts to boot) the insurance agency sent her an email claiming that due to an alleged lack of contact on her end, they would close the claim soon. Mind, my friend hasn’t deleted any of her receipts, so she has all of her attempts to contact them on record. So we sent them another email that indicated she’d been contacting them and that we’d be pursuing legal action if they kept refusing to respond to her. A bit heavy handed, but it worked, as they finally got into contact with her, asking for the police case number.

To this end, my roommate had been clever enough to get the case number from the police, so she sent it back to the agency and… nothing. Again. We got radio silence from the agency once more until they said that lack of correspondence with the police case number would result in the claim being closed. And once again, my friend sent them receipts of where she’d been trying to contact them including the email with the case number.

Today, they sent her a text saying that they closed her claim, and only would open the case again if they were given the police case number. At this point I believe there’s no way but to actively pursue legal action - but I wanted a second opinion. Do we have a case here? I’m pretty sure we do, but this is the first time we’ve had to deal with something like this.
