[tx] Prior Supervisor Giving False, Negative Reference Jeopardizing Security Clearance. Can They Be Sued?

Posting for my coworker who is dealing with this issue. He’s recently learned that his former supervisor gave a negative reference. Not only that, but it was false too. Because of that, his security clearance adjudication might be in jeopardy.

The background investigator disclosed this to him. The investigator basically called him and gave him the heads up that his old supervisor gave a very odd, cryptic reference and called my coworker “a liar” with no other explanation. Obviously, considering this is a security related position, claims regarding one’s integrity make a big difference. My friend had otherwise glowing references and spotless record.

He’s extremely upset about this and fears that this supervisor might ruin his future job prospects. Removing the supervisor from the reference list isn’t an option. The security forms require listing all former sups.

What recourse does he have against this supervisor? What kind of attorney should he seek, if any? TIA.
