[va] My Husband Entered My Home Without Permission Despite Ppo & Took Marital Property While I Was Away.

Location: Virginia

I’m going through a contested divorce involving DV, a PPO, & a husband who has completely cut off financial support while I’m struggling to keep a roof over my child’s head.

Background:

In September 2026, my husband was arrested for felony strangulation following an incident that occurred in front of our youngest child. He subsequently pleaded guilty to misdemeanor DV.

Through PPO proceedings, I was awarded exclusive possession of our marital residence and sole physical & legal custody of our child.

The PPO also specifically prohibits him from surveilling me. I suspect he violated that because how else would he know for sure that I wasn’t home?

Our temporary child & spousal support hearing was continued until December.

Before either of us filed for divorce, he unilaterally excluded me from our lease renewal, despite my being on the lease in 2023, 2024, & 2025. When I asked about renewing it, he assured me he’d handled everything. Months later, I discovered he’d excluded me without my knowledge, ultimately leaving me facing eviction as a tenant at sufferance.

I’ve been a stay-at-home mother for over a decade with no independent income. Since his arrest, he has provided absolutely no financial support.

What happened:

While I was on my way to our temporary child & spousal support hearing, my husband entered our marital residence without my knowledge or permission & removed marital property. This is the same residence the court awarded me exclusive possession of under the protective order.

I initially suspected he’d entered when I noticed belongings missing. I checked our nanny camera & Ring footage, but there were no recordings showing him entering or leaving. I suspect he deleted the footage, although I can’t prove it.

Over the following days, both my mother & adult child contacted me, saying he’d been bragging about entering the home & taking things.

He was also nearly 30 minutes late to our court hearing that day & had to call the courthouse to let them know he was running late.

It’s frustrating that I’m expected to follow every court procedure while he seemingly disregards an existing protective order. And not to mention the fear I’m now stuck with again because I no longer feel safe even with the PPO knowing he’s clearly willing to violate it.

My concerns:

Since his arrest, my husband has abandoned his financial responsibilities. After spending over a decade raising our family, I’m now trying to rebuild my life without income, support, or secure housing. Meanwhile, he appears to be violating the very court order meant to protect me.

I understand that reporting this incident could potentially affect his plea agreement & probation. I’m not interested in threatening him or doing anything unlawful, but I also wonder whether this incident provides any legitimate legal leverage toward securing financial support & reaching an enforceable settlement.

My questions:

Does entering a residence awarded to the other party for exclusive possession constitute a violation, even if he previously lived there & the belongings removed are marital property?

Could this incident support a motion for additional protective relief, pendente lite child & spousal support or court-ordered alternative housing, especially given his role in creating our housing instability?

Given his apparent PPO violation & refusal to provide support, what’s the most effective legal avenue for enforcement & obtaining temporary child & spousal support? Are emergency options available before December?

I’m not trying to misuse the legal system. I just want to understand my rights, pursue lawful remedies & see if there’s a way I can strategize this. It’s exhausting watching him destabilize our lives while I’m left dealing with the consequences.

Thank you.
