Not An On Call Employee, But Job Is Essentially Making Us On Call (ms)
Location: mississippi
I got the job offer for this job on 10/8. When it was offered to me it was for an 11am start time, off sundays and mondays. I accepted. Orientation was 10/14.
On the last day of orientation on 10/17, they changed it to a 4:30am start time, still off sunday Monday.
Then they started changing the shift times (usually pushing it back to 5 or 5:30) around 3 am every day
So this past Monday (11/2) I wake up at 8 am and see that at 3:24am they added a shift with a 4:30 am start time. Even if i had seen it, I couldn't have reasonably gotten here on time, I live 45 min away. And it takes 20 min to get from the parking lot to the clock (you need to go through security then cross the street to a second building which the clock is in back on the second story of).
Tuesday I brought it up to my supervisor. He said our off days are only suggestions but not set in stone and that we need to get up to check the app every day and we need to check it hourly from midnight on.
Today, I was set to start at 5. I wake up and see that at 2:30 am the start time was pushed up from 5am to 3am.
I told him again that hey, I live 45 minutes away. I am not going to kill myself for this job.
He suggested that I get up at midnight and sit in the parking lot incase of time changes. Including on my days off.
Then no matter what time is scheduled off they send us home at 3 hrs.
Is this legal for them to basically make us be on call even though we aren't paid as on call
