Business Name Confusion
Location: California
My wife started a small business in California in mid 2020. She’s an esthetician. I won’t give the exact name because name of her business, but an example would be “Sunset Skincare”. As of recently she got a random yelp review that made no sense. It talked about medical skincare services that my wife doesn’t provide. And just this morning she got a phone call from someone who recently had medical assistance, and called her for help. At this point we’ve realized there is a business called just “Sunset” that provides telemedicine dermatology. Looking in to it, the business was founded in late 2020 under a completely different name. They changed their name in 2022 to this new name that has clearly caused confusion in the market.
What should we do? I’m mostly concerned that this bigger business could come to the same conclusion, and demand my wife change her business name. Obviously she was using the
name for a couple of years before they did. To protect her business do we actually need to make the demand ourselves?
