Can I Get Sued For Firing Someone With A Disability When They Make False Assumptions?
Location: NC
I am an owner of a business regarding scheduled appointments for animals to be bathed.
I recently hired an employee to work one day per weekend only. She made it clear she had a few physical limitations and also a headache disorder for which there was a service animal for alerting (the dog didn’t act like a service animal and it was quite literally unruly and barking at other dogs when she was present)
She was scheduled to work 6 times and of those six times, she called out 4 times and then showed up very late the other 2.
The reasons for calling out or being late were family emergency, headaches, nausea due to antibiotics and then the most recent one, a random hand muscle cramp that prevented her from working.
So I did let her go, and stated very clearly it was because she was unreliable and was hurting my business.
She then comes back with an accusation that I fired her because of her “disability” which was not true in the slightest. She then continues to claim that she was injured at my salon because of lifting a large dog. (I had my husband and my other groomer there to help her lift and hold the animal safely so she didn’t have to exert herself )
She said she had to see a doctor due to the injuries acquired that day. First I’ve heard of that.
So basically, can I be sued? Is this even grounds for legal action? I’m worried that she will continue to lie and accuse me of firing her due to her disability, and not her reliability.
