Condo Water Issues

Location: Central VA

I live in a condo in that is only 3 years old. I am on the 3rd floor and the condo above me on the 4th floor has been abandoned for 2 years and the owner has died. During December of last year right before Christmas their hot water heater burst and it rained down on my little shed with my water lines and AC unit. I was able to get ahold of the owners son and filed an insurance claim as did he. Everything was fixed and we went back and forth a bit until Feb where the exact same thing happened again. I had to file another claim and get Servpro and my AC checked out. I also had Sheet rock damage as well as mold mitigation. All told it was 6k in damages all covered by my insurance but I had an $1000 copay. My insurance is telling me that it is not going after his insurance for subrogation as it is not worth it. So I am on the hook for the copay with 2 claims on my homeowner’s insurance! I am just wondering is it worth going after the son for my copay? I feel like I have taken the hit to my insurance and this has been a nightmare to deal with, especially on a brand new place. I want the $1000 just so he pays something. Is this worth it? Do I have a case?
